Terms of use

Reference text: version 2026-09-19 of the terms presented in the app [effective date to be set]. ProxiBlu is operated by Technologies DareCrush inc. [registered office address]. By creating a ProxiBlu account, you accept these terms, our privacy policy and our child safety standards.

Document to be finalized before going live. This text reflects how the service actually works and the rules imposed by the app stores, but the legal form, governing law and liability limits must be validated by legal counsel. The highlighted passages remain to be settled.

1. The service

ProxiBlu is a dating app that shows you people you have genuinely crossed paths with physically, detected over Bluetooth [addition to be merged into the reference text: and, if you turn it on, people who frequent the same areas as you (“Around my places”)]. The service is provided “as is”. We may change it, suspend features for maintenance, or require an app update in order to keep using it.

How well detection works depends on your device, its settings and its battery management. We do not guarantee that any given encounter will be detected.

2. Eligibility

You must be 18 or over and legally able to enter into a contract. The app is prohibited to minors. By creating an account, you confirm that you meet these conditions.

At sign-up, we read the platform's age signal when it provides one. We may, at any time, ask you for a selfie taken with the camera — the app then allows nothing else until it is sent — and block an account we have reason to believe belongs to a minor.

3. Your account

You are responsible for the accuracy of your profile information and for the security of the device you are signed in on. An account is strictly personal: one person, one account, one phone number. It may be neither shared nor transferred.

You can delete your account at any time, from the app or from the “My account” web portal, even after uninstalling the app.

4. Rules of conduct — zero tolerance

There is no tolerance for objectionable content or abusive behaviour. You agree not to:

  • post a photo or text containing nudity, full or partial, or sexually explicit or suggestive content;
  • post, request or share any child sexual exploitation or abuse content, or attempt to make contact with a minor — these facts are reported to the authorities and the account is closed;
  • harass, threaten, intimidate, stalk or blackmail another person;
  • post hateful, violent or discriminatory content;
  • impersonate someone else, post another person's photo, or create more than one account;
  • solicit money, defraud, advertise or canvass;
  • use the app for illegal purposes, or circumvent its security measures — modifying the app, fake encounters, automation, attempting to forge, replay or harvest other people's Bluetooth beacons.

You can report and block any user from the app. We review reports and may, without notice, remove content, or suspend, freeze or delete an account that breaks these rules. We report to the competent authorities the facts that require it, in particular any child sexual exploitation content, and we cooperate with them on a valid legal request.

5. Content you post

You keep your rights to your photos and your description, but you grant us the limited right to host them and display them to the people you cross paths with, in order to run the service. You warrant that you have the right to share what you post and that each photo shows you.

Your photos and texts may be analyzed automatically and reviewed by our team before or after they are published; we may refuse or remove content that breaches these terms, and ask you to replace it. That right ends when you remove the content or delete your account.

[Addition to be merged into the reference text.] What you post in a public event or a public group is meant to be read by other members and by our moderation team: put no private information there. A public group appears as soon as it is paid for (or as soon as it is created, when groups are free), and any public space may be removed if it breaches these terms.

6. Dating safety

ProxiBlu connects people who may go on to meet in real life. We do not verify users' identity or background. An encounter attests to physical proximity, nothing more.

You alone are responsible for your interactions. Be careful: meet first in a public place, tell someone you trust, and use the built-in safety location sharing. In immediate danger, contact the emergency services. Our safety advice sets out the right reflexes.

7. Subscriptions and payments

Some features are paid; the detail and price of each plan are shown before purchase. Sharing contact details and the safety features are never paid, and no plan allows anyone to override another person's gender preferences.

  • Purchase in Apple's App Store or on Google Play: the subscription is billed by the platform and renews automatically at each term, at the price shown, until you cancel it in the platform's settings; refunds follow its rules. Deleting your ProxiBlu account or uninstalling the app does not cancel a subscription bought in a store: cancel it first in the App Store or on Google Play.
  • Card payment on our site, if it is offered to you: automatic renewal is stated before payment; you can switch it off at any time from the app or the “My account” web portal, and the period already paid for runs to its end. Deleting your account stops that renewal. [Applicable taxes and the notices required by the Consumer Protection Act for automatically renewing contracts: to be validated before card sales open.]
  • Credits (referrals, promotions): they have no cash value, are neither refundable nor transferable, and are lost when the account is deleted. A subscription paid with credits renews with credits at its term, unless you have switched that renewal off in the app or on the portal.
  • [Addition to be merged into the reference text.] Purchases in the Social tab: publishing a public event and opening a group, for a renewable year, may be paid. The price depends on how many people the space will be able to hold (a tier, chosen before purchase); it is shown before purchase, paid through the app store or with credits. A full space can be enlarged to the next tier by paying the difference, with credits only. A group whose year is unpaid stays readable by its members, but nobody can join it or write in it. [Refund conditions for these purchases to be specified.]

8. Suspension and termination

We may suspend, freeze (during a check) or close an account that breaches these terms or the law, or to protect other users. An account subject to consistent reports may be frozen pending human review.

You may stop using the service and delete your account at any time; what deletion erases and what is kept is described in our privacy policy.

9. Liability

To the extent permitted by law, ProxiBlu is provided without warranty and we disclaim any liability for damages arising from interactions between users or from use of the service. [Liability caps and exclusions to be specified by counsel according to the jurisdiction; certain consumer protections cannot be waived.]

10. Governing law

These terms are governed by the law [of the Province of Quebec / to be specified], subject to the mandatory consumer protection rules of your place of residence.

11. Changes

We may amend these terms; the current version is shown at the top. With each new version, the app presents the text to you and asks you to accept it again before continuing.
